Canon announced the resolution of a patent infringement case against Shanghai Baiyingmei Printer Consumables Co., Ltd. and Zhejiang Baiyingmei Printer Consumables Co., Ltd. The lawsuit pertained to toner cartridges intended for use in various models of HP laser beam printers.
The origins of the case trace back to June 2021, when Canon initially filed a lawsuit against the two companies, alleging infringement of a Chinese patent owned by Canon. The infringed patent primarily relates to the manufacturing and distribution of several toner cartridge models, including PTCRG-119/319/519/719-CE505A, PTCE505A, PTCE505XL, PTCRG-119II/319II/519II/719II-CE505X, PTCE505X, PTCF280A, PTCF280X, PTCE255A, PTCE255X, PTCF226A, PTCF226X, PTCF287A, PTCF287X, PTCF228A, and PTCF228X.
In March, 2022, Zhejiang Baiyingmei filed an appeal to the Shanghai Intellectual Property Court, seeking to overturn the original ruling and transfer the case to the Ningbo Intermediate People’s Court in Zhejiang. Zhejiang Baiyingmei argued that it merely offered rental services to Shanghai Baiyingmei and contested the joint action against both companies.
In February, 2024, Shanghai Intellectual Property Court made a final judgement in favor of Canon and verified the infringement of patent regarding the aforementioned toner cartridges. The court orders the two defendants to stop the infringements and compensate Canon accordingly. With no further appeals filed, the judgment stands as final.
Throughout the development, sales and marketing process, Canon respects the intellectual property rights owned by other companies and individuals and expects others to similarly respect Canon’s intellectual property rights. Canon remains committed to pursuing legal enforcement against those who do not respect Canon’s intellectual property rights.
