A recent review by the European Toner and Inkjet Remanufacturers Association (ETIRA) has raised concerns about the compliance of new non-OEM toner cartridges sold in Europe. The findings reveal that 75% of these cartridges fail to meet EU standards, with only 8% achieving full compliance. In comparison, remanufactured OEM cartridges showed significantly better results, with 85% meeting most or all regulatory requirements.
Compliance Audit Highlights
Between July and November 2024, compliance checks were conducted on approximately 50 non-OEM and remanufactured OEM toner cartridges across Germany, France, the Czech Republic, Romania, Spain, and Italy. The products were obtained from well-known suppliers, including Plate Bürobedarf, Kaut-Bullinger, Ribbex, and TonerPartner GmbH, among others.
Findings on Non-OEM Cartridges
- High Non-Compliance Rates: 75% of new non-OEM cartridges failed to meet basic requirements, including CE marking, proper WEEE registration, and valid Declarations of Conformity.
- Misleading Labels: Some products falsely claimed to be remanufactured or made in the EU, despite being imported from Southeast Asia.
- Packaging Issues: Supplier information was often incomplete or listed suppliers outside the EU, raising further compliance questions.
A notable example involved cartridges labeled as “Rebuilt” and “Made in Germany” but found to be new non-OEM products imported by a Portuguese distributor.
Performance of Remanufactured OEM Cartridges
In contrast, 85% of remanufactured OEM cartridges showed relative compliance, with only minor issues such as missing national WEEE registration in isolated cases.
ETIRA’s findings align with earlier tests showing that non-OEM toner cartridges often contain hazardous chemicals, such as decaBDE, and emit harmful substances during use. These practices pose risks to public health and the environment while undermining businesses that comply with EU regulations.
ETIRA’s Call to Action for Buyers and Regulators
ETIRA has reported these compliance violations to national authorities and emphasized the need for stricter enforcement of EU directives, including REACH and WEEE. “Over 30% of the market is illegal, threatening fair competition, environmental care, and consumer health—urgent action is essential,” said Mr. Javier Martinez, ETIRA President, who called for urgent regulatory action.
Buyers and suppliers are reminded that compliance with EU regulations is mandatory for all cartridges sold in the region. Importers are responsible for ensuring their products meet these standards, with non-compliance potentially leading to legal penalties.
